Chapters 9 and 10 of the Eligible for Execution book (and chapter 8 if you wish to read it) walk the reader through the appeals process in a death row case from the preparation elements to the final decision of the Supreme Court.
After reading the chapters and learning about the process, identify one aspect of the appeals process and/or how the Supreme Court operates that was new or interesting to you (such as the selection of lawyers, oral arguments, the writing of the Supreme Court opinion, etc.).
Describe this element. How did this element play a part in the Atkins’ appeal/decision?
Reference the case specifically. Would you recommend any changes to this element of the process to make it more fair or streamlined based on the Atkins case?
